The Eighth Appeal Administrative Court in Lviv ordered the Pension Fund to recognize the woman's 13 years of work experience in Russia and to re-examine her application for pension. The court ruled that the denial of the pension application due to insufficient work experience was unlawful.
The Eighth Appeal Administrative Court in Lviv ordered the Main Department of the State Pension Fund of Ukraine in the Cherkasy region to recognize the woman's 13 years of work experience in Russia and to re-examine her application for pension.
In March 2026, a 60-year-old woman contacted the Pension Fund, requesting to be granted a retirement pension. The agency denied the request due to insufficient insurance experience, crediting only 27 years, 2 months, and 14 days. The reason for the denial was that the Pension Fund did not take into account periods of work in Russia from 1992 to 2005.
According to her employment record, the woman worked as a primary school teacher at the Харь'ягин Primary School, and later at the Kolvin Oil Exploration Expedition and the company "Bovel". The first-instance court in Ivano-Frankivsk ruled in favor of the woman, declaring the Pension Fund's refusal unlawful. The appellate court in Lviv rejected the Pension Fund's appeal, stating that the woman worked in Russia when the relevant international agreement was in effect. Ukraine's withdrawal from the agreement in 2023 does not justify not recognizing this work experience. The decision of the appellate court can be appealed to the court of cassation.
