A tram driver from Lviv successfully sued and secured a pension of 50 years.
The Lviv Regional Administrative Court ordered the Pension Fund to assign a disability pension to a tram driver, aged 50, employed by LKP "Lviv ElectriTransport". The woman, who has more than 30 years of service, turned to the court after being denied benefits due to her age.
The Lviv Regional Administrative Court issued a decision requiring the Pension Fund to appoint a disability pension to a tram driver, aged 50, employed by the Lviv Electric Transport company («Lьвівелектротранс»). The woman began working as a tram driver in September 1994 and has more than 30 years of experience.
In June of this year, upon reaching 50 years of age, she applied to the Pension Fund for the assignment of a pension with benefits. However, in July, the Main Office of the Pension Fund in the Vinnytsia region denied her request, citing the fact that she had not yet reached 55 years of age. At the same time, the Pension Fund confirmed that she had over 28 years of insurance experience and almost 27 years of benefit experience.
The tram driver disagreed with the Pension Fund's decision and turned to court. She explained that, according to the law, she is entitled to a reduced pension from 50 years, as she started working as a tram driver before 2015 year, and has the necessary work experience. The court sided with the woman from Lviv, ruling that she had met all the conditions for early retirement.
The court ordered the Pension Fund to assign a pension to the woman starting the day after her 50-year anniversary. In addition, the Pension Fund must reimburse the resident of Lviv 1331 UAH in court fees. The decision can still be appealed.
