Court Orders Farmer to Return Over 69 Hectares of Land to Community in Stryy

The Economic Court of the Lviv region ordered a farmer and the "Dnipro" agricultural enterprise to return two land plots, totaling over 69 hectares, to the Rozdriv community. The court ruled that the land was leased without a land auction, although the lessee had already received the plots under favorable conditions.

The Economic Court of the Lviv region issued a decision obliging the farmer and the "Dnipro" agricultural enterprise to return two land plots, totaling over 69 hectares, to the Rozdriv community.

The court established that in 2014, the Main Department of the State Land Service in the Lviv region leased the 55.8 and 13.4 hectare plots to the farmer for 20 years for the operation of the "Dnipro" agricultural enterprise. However, it turned out that this farmer had already received state-owned land for the operation of the enterprise without an auction, so he could only obtain the subsequent plots on a competitive basis.

Representatives of the agricultural enterprise "Dnipro" disputed the lawsuit, claiming that the land plots were leased out before the changes in legislation that introduced mandatory land auctions. However, the court ruled that the lawsuit was justified and fully satisfied it. The decision can be appealed.

It should be noted that this is not the first time that this farmer and the agricultural enterprise "Dnipro" have been required to return land. Previously, the court ordered them to return two land plots, totaling almost 28 hectares, to the Zhovkva city council, two plots, totaling almost 49 hectares, to the Velikomosyt village community, and 33 hectares to the Trostenets community in the Stryy district.
