A military medic was forced to leave service after a court ruling
The Lviv Regional Administrative Court ruled in favor of the senior combat medic, who had filed a lawsuit demanding to be released from service to care for his disabled father. The court found the military unit's refusal to be unlawful and ordered it to release the soldier.
The Lviv Regional Administrative Court ruled that the military unit's refusal to release the senior combat medic to care for his disabled father was unlawful.
A military servicemember filed a lawsuit, arguing that the rejection was unlawful. In the case materials, a representative of the military unit stated that the plaintiff's father has a wife, and that the documents provided regarding the father's health were improperly prepared, and did not confirm the need for constant outside care.
Judge Oleh Kravtsev, after reviewing the case materials, concluded that the ability of family members to provide ongoing care should be assessed. The plaintiff's mother is a pensioner and is unable to provide ongoing care, according to the opinion of the Social Security Department. Since both parents of the plaintiff are unable to work, the court ruled that the denial of part of the release was unlawful, based on paragraph "g" of section 2, paragraph 4, and article 26 of the Law of Ukraine "On Military Duty and Military Service."
The military unit was required to make a decision to discharge the plaintiff due to the need for constant care for the father, who has a disability rating of the second group. The decision can be challenged.
